BOARD OF ASSESSMENT APPEALS
March 19, 2011

The meeting opened at 9:00 a.m.

APPEALS AND RESULTS

Appeal #1:  21 Rockledge Drive – Ildegardo Victor Espinoza, Owner

Mr. Espinoza pointed out some errors that he discovered on his property card.  He stated that the basement garage is a two car garage, not a three car garage.  He also stated that there is no whirlpool and that the in ground pool is in poor condition and is not being used.  He compared his house to several others and felt that it was being assessed at a much higher rate.  He feels that the value of his property should be $309,000 instead of the Town’s value of $389,310.

After careful deliberation, the Board voted to correct the errors resulting in a new value of $357,430.

Appeal #2:  112 West Main Street – Marlene Jung, Owner

Ms. Jung stated that she had been trying to purchase this building, which was in foreclosure, for about three years and finally did so in September 2010.  The purchase price of $232,000 was the highest price that anyone was willing to pay for it. This house was built in 1850 and is only being used for offices on the first floor.  The second floor is being used only for storage.  Because it was a house, there is very little parking there which would make it hard to have a tenant.  She feels the value should be $232,000 instead of $380,070.

After careful deliberation, the Board voted to make adjustments to the property, lowering the value to $324,690.

Appeal #3:  9 Gateweood – Kathy A. Beach, Owner

Ms. Beach stated that she has been trying to sell this unit since 2008 and right now it is being rented.  She stated that it is a Willow model and is a middle unit but is being assessed the same as end units.  She also had several comparisons to other models which she thought were bigger than hers but were being assessed at a lower rate.

After researching the information, the comparables presented had basement square footage added to the living area which is in error.  The Board voted unanimously that no adjustment should be made.

Appeal #4:  67 Reverknolls – Denied by Statute - DID NOT APPEAR.

Appeal #5:   50 Tower Lane – Mark A. Balaban, Esq.
                                                 Fifty Tower Lane, LLC, OWNER

Attorney Schrager stated that this building was leased to Reflexite until August of 2009 and it was empty until August 2010.  Only about 60,000 square feet of space has been leased now and there has been a 30% drop in income.  An appraisal was commissioned in May of 2010 indicating a value of $1,750,000, which he feels is closer to the actual value at this time.

After careful deliberation, the Board voted unanimously that no adjustment be made at this time.   

Appeal #6:  105 Darling Drive – Mark A. Balaban, Esq.
                                                     Connecticut on Line Computer Center, Inc. – OWNER

Attorney Balaban stated that this is a mixed use building and is owner occupied.  He presented information on leasing rates and partial vacancy, indicating a value of $1,978,286.

After careful deliberation, the Board voted unanimously that no adjustment be made at this time.

Appeal #7:  135 Darling Drive – Mark A. Balaban, Esq.
                                               Connecticut On Line Computer Center, Inc. – OWNER

Attorney Balaban submitted information on leasing rates, although this is an owner occupied building, indicating a value of $2,832,439.  The Town’s value if $4,472,930.

After careful deliberation, the Board voted unanimously that no adjustment be made at this time.


The meeting adjourned at 12:00 noon.
